Or maybe the developers of those games have given their assurance to Valve that they own all the relevant copyright, and therefore the same standard is being applied?

If they claimed that then they lied because we all know those games studios didn't train their own Image gen models without relying on the base SD models


Maybe they did, maybe they didn't. But if the developer is willing to sign a document saying they own the rights, that's probably good enough for Valve to feel their ass has been covered.
